Roubler\nWebsite Terms of Use<\/strong><\/h2>\n\n\n\n

Roubler (“Roubler”) operates each website\n(“Site”) that links to these Terms of Use to provide online access to\ninformation about Roubler and the products, services, and opportunities we\nprovide. Use of the Roubler Service is governed by our Customer Terms of\nService, available on this website<\/p>\n\n\n\n

By accessing and using the Site, you agree to these Terms of\nUse.<\/p>\n\n\n\n

Roubler reserves the right to modify these Terms of Use at\nany time without giving you prior notice. Your use of the Site following any\nsuch modification constitutes your agreement to follow and be bound by these\nTerms of Use as modified. The last date these Terms of Use were revised is set\nforth below.<\/p>\n\n\n\n

1. Permitted Use of The Site<\/h4>\n\n\n\n

You may use the Site, and the information, writings, images\nand\/or other works that you see, hear or otherwise experience on the Site\n(singly or collectively, the “Content”) solely for your\nnon-commercial, personal purposes and\/or to learn about Roubler products and\nservices, and solely in compliance with these Terms of Use.<\/p>\n\n\n\n

2. Prohibited Use of The Site<\/h4>\n\n\n\n

By accessing the Site, you agree that you will not:<\/p>\n\n\n\n

  • Use the Site in violation of these Terms of Use;<\/li>
  • Use the Site in violation of the terms of\nRoubler’s Acceptable Use Policy<\/li>
  • Copy, modify, create a derivative work from,\nreverse engineer or reverse assemble the Site, or otherwise attempt to discover\nany source code, or allow any third party to do so;<\/li>
  • Sell, assign, sublicense, distribute,\ncommercially exploit, grant a security interest in or otherwise transfer any\nright in, or make available to a third party, the Content or Service in any\nway;<\/li>
  • Use or launch any automated system, including\nwithout limitation, “robots,” “spiders,” or “offline\nreaders,” that accesses the Site in a manner that sends more request\nmessages to the Roubler servers in a given period of time than a human can\nreasonably produce in the same period by using a conventional on-line web\nbrowser;<\/li>
  • Use the Site in any manner that damages,\ndisables, overburdens, or impairs any Roubler website or interferes with any\nother party’s use and enjoyment of the Site;<\/li>
  • Mirror or frame the Site or any part of it on\nany other web site or web page.<\/li>
  • Attempt to gain unauthorized access to the Site;<\/li>
  • Access the Site by any means other than through\nthe interface that is provided by Roubler for use in accessing the Site;<\/li>
  • Use the Site for any purpose or in any manner\nthat is unlawful or prohibited by this Agreement.<\/li>
  • Any unauthorized use of any Content or the Site\nmay violate patent, copyright, trademark, and other laws.<\/li><\/ul>\n\n\n\n

    3. Copyrights and Trademarks<\/h4>\n\n\n\n

    The Site is based upon proprietary Roubler technology and\nincludes the Content. The Site is protected by applicable intellectual property\nand other laws, including trademark and copyright laws. The Site, including all\nintellectual property rights in the Site, belongs to and is the property of\nRoubler or its licensors (if any). Roubler owns and retains all copyrights in\nthe Content. Except as specifically permitted on the Site as to certain\nContent, the Content may not be copied, reproduced, modified, published, uploaded,\nposted, transmitted, performed, or distributed in any way, and you agree not to\nmodify, rent, lease, loan, sell, distribute, transmit, broadcast, or create\nderivative works based on the Content or the Site, in whole or in part, by any\nmeans. Roubler, the Sprocket Design, the Roubler logos, and other marks used by\nRoubler from time to time are trademarks and the property of Roubler. The\nappearance, layout, colour scheme, and design of the Roubler.com site are\nprotected trade dress. Customer does not receive any right or license to use\nthe foregoing. Roubler may use and incorporate into the Site or the Roubler\nService any suggestions or other feedback you provide, without payment or\ncondition.<\/p>\n\n\n\n

    4. Information and Materials You Post or Provide<\/h4>\n\n\n\n

    You represent that you have all right, title, and interest\nto materials you post on the Site or provide to Roubler\n(“Materials”), including but not limited to any consent,\nauthorization, release, clearance or license from any third party (such as, but\nnot limited to, any release related to rights of privacy or publicity)\nnecessary for you to provide, post, upload, input or submit the Materials, and\nthat posting such Materials does not violate or constitute the infringement of\nany patent, copyright, trademark, trade secret, right of privacy, right of\npublicity, moral rights, or other intellectual property right recognized by any\napplicable jurisdiction of any person or entity, or otherwise constitute the\nbreach of any agreement with any other person or entity. You further represent\nand warrant that you are who you say you are, that you have not submitted\nfictitious, false or inaccurate information about yourself, and that all\ninformation contained in the posted Materials is true and your own work or work\nyou are authorized to submit, and that the posted Materials do not contain any\nthreatening, harassing, libelous, false, defamatory, offensive, obscene, or\npornographic, material, or other material that would violate any other\napplicable law or regulation. You agree that you will not knowingly and with\nintent to defraud provide material and misleading information. You represent\nand warrant that the Materials you supply do not violate these Terms of Use.<\/p>\n\n\n\n

Roubler is not responsible for the\navailability of any such web sites. Roubler is not responsible or liable for\nany such web sites or the content thereon. If you use the links to the web sites\nof Roubler affiliates or service providers, you will leave the Site and will be\nsubject to the terms of use and privacy policy applicable to those web sites.<\/p>\n\n\n\n

    6. Downloading Files<\/h4>\n\n\n\n

    Roubler cannot and does not guarantee or warrant that files\navailable for downloading through the Site will be free of infection by\nsoftware viruses or other harmful computer code, files or programs. <\/p>\n\n\n\n

    7. Disclaimers; Limitations of Liability<\/h4>\n\n\n\n

    ROUBLER AND ITS SERVICE PROVIDERS, LICENSORS AND SUPPLIERS\nMAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY,\nTIMELINESS, SECURITY OR ACCURACY OF THE SITE OR THE CONTENT FOR ANY PURPOSE. TO\nTHE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE,\nPRODUCTS, SERVICE AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT\nWARRANTY OR CONDITION OF ANY KIND. ROUBLER AND ITS SERVICE PROVIDERS, LICENSORS\nAND SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND WITH\nREGARD TO THE SITE AND THE CONTENT, INCLUDING ALL IMPLIED WARRANTIES OR\nCONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND\nNON-INFRINGEMENT.     IF, NOTWITHSTANDING THE OTHER TERMS OF THIS AGREEMENT,\nROUBLER IS DETERMINED TO HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY FOR ANY\nLOSS, HARM OR DAMAGE, YOU AGREE THAT THE AGGREGATE LIABILITY OF ROUBLER AND ITS\nOFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS,\nSERVICE PROVIDERS, LICENSORS OR SUPPLIERS SHALL IN ALL CASES BE LIMITED TO ONE\nHUNDRED DOLLARS. <\/p>\n\n\n\n

    8. Indemnification<\/h4>\n\n\n\n

    You understand and agree that you are personally responsible\nfor your behavior on the Site. You agree to indemnify, defend and hold harmless\nRoubler, its parent companies, subsidiaries, affiliated companies, joint\nventurers, business partners, licensors, employees, agents, and any third-party\ninformation providers from and against all claims, losses, expenses, damages and\ncosts (including, but not limited to, direct, incidental, consequential,\nexemplary and indirect damages), and reasonable attorneys’ fees, resulting from\nor arising out of your use, misuse, or inability to use the Site or the\nContent, or any violation by you of these Terms of Use.

    9. Privacy<\/strong><\/h4>\n\n\n\n

    Your use of the Site is subject to Roubler’s Privacy Policy.\n<\/p>\n\n\n\n

    10. Additional Terms of Service<\/h4>\n\n\n\n

    If you are a customer of Roubler or an employee,\nrepresentative or agent of a Roubler customer, your use of the Roubler Service\nis subject to Roubler’s Terms of Service.<\/p>\n\n\n\n

    11. General Provisions<\/h4>\n\n\n\n

    a. Entire Agreement\/No Waiver.\nThese Terms of Use constitute the entire agreement of the parties with respect\nto the subject matter hereof. No waiver by Roubler of any breach or default\nhereunder shall be deemed to be a waiver of any preceding or subsequent breach\nor default.<\/p>\n\n\n\n

    b. Correction of Errors and\nInaccuracies. The Content may contain typographical errors or other errors or\ninaccuracies and may not be complete or current. Roubler therefore reserves the\nright to correct any errors, inaccuracies or omissions and to change or update\nthe Content at any time without prior notice. Roubler does not, however,\nguarantee that any errors, inaccuracies or omissions will be corrected.<\/p>\n\n\n\n

    c. Enforcement\/ Choice of Law\/\nChoice of Forum. If any part of these Terms of Use is determined by a court of\ncompetent jurisdiction to be invalid or unenforceable, it will not impact any\nother provision of these Terms of Use, all of which will remain in full force\nand effect. Any and all disputes relating to these Terms of Use, Roubler’s\nPrivacy Policy, your use of the Site, any other Roubler web site or the Content\nare governed by, and will be interpreted in accordance with, the laws of the\nCommonwealth of Australia, without regard to any conflict of laws provisions.\nYou agree to the sole and exclusive jurisdiction and venue of the federal or\nstate courts in Queensland, Australia in the event of any dispute of any kind\narising from or relating to these Terms of Use, Roubler’s Privacy Policy, your\nuse of the Site, any other Roubler web site or the Content<\/p>\n\n\n\n
