{"id":5394,"date":"2017-07-10T09:30:10","date_gmt":"2017-07-09T23:30:10","guid":{"rendered":"https:\/\/roubler.com\/au\/?p=5394"},"modified":"2018-08-22T10:15:34","modified_gmt":"2018-08-22T00:15:34","slug":"fair-work-casual-workers-permanent","status":"publish","type":"post","link":"https:\/\/roubler.com\/au\/resources\/blog\/fair-work-casual-workers-permanent\/","title":{"rendered":"Fair Work Gives Casual Employees the Right to Permanent Positions"},"content":{"rendered":"<p>In a major decision by the <a href=\"https:\/\/www.fairwork.gov.au\/\">Fair Work <\/a>Commission (FWC), more than 2 million casual workers in Australia have won the right to ask for permanent employment.<\/p>\n<p>The ruling, handed down July 5, allows casual workers to request an ongoing position if they have worked consistent hours over 12 months. The <a href=\"https:\/\/roubler.com\/au\/fair-work-amendment\/\">FWC<\/a> agreed with arguments from unions that unrestricted use of casual workers was unfair and undermined Australia\u2019s National Employment Standards safety net. The National Employment Standards set out 10 minimum employment benefits for Australian workers. However, casual workers are currently only eligible for two.<\/p>\n<h3>How do casual workers become permanent?<\/h3>\n<p>The new rules will be included in 85 <a href=\"https:\/\/roubler.com\/au\/modern-award-interpretations\/\">modern awards<\/a>, allowing casual workers to request permanent work under certain conditions:<\/p>\n<ul>\n<li>A qualifying period of 12 months work.<\/li>\n<li>The work must be in a regular pattern of hours, which without adjustment could fulfil the conditions of a part- or full-time position.<\/li>\n<li>All employees must be notified of their right to convert within 12 months of their start date.<\/li>\n<\/ul>\n<p>The Australian Industry Group, and Recruiting &amp; Consulting Services Australia &amp; NZ both unsuccessfully sought to remove the notification obligation in about 20 of the awards. AIG Chief Executive Innes Willox called the union arguments \u201cloopy\u201d and \u201cbogus\u201d. Furthermore, he said that the decisions are concerning for employers.<\/p>\n<p>&#8220;Today&#8217;s decision will reduce flexibility for some employers in some industries and this is a concern given the tough operating environment that many businesses are experiencing.&#8221;<\/p>\n<p>The Australian Council of Trade Unions (ACTU) unsuccessfully argued for automatic conversion after a set period of time. In its ruling, the FWC said people accepting casual employment were doing so on an \u201cuninformed basis\u201d. They said that the changes would lead to better mutual benefit of accepting insecure work. The ACTU estimates as much as 40 per cent of Australia\u2019s workforce is in \u201cinsecure work\u201d, such as casual or contract work.<\/p>\n<p>ACTU Secretary Sally McManus said permanent work allows Australians to plan for their future with some certainty.<\/p>\n<p>\u201cCasual workers earn less wages and lower superannuation,\u201d Ms McManus said.<\/p>\n<p>\u201cToo many employers have been abusing the term casual, and use it as a business model to drive down wages.&#8221;<\/p>\n<p>\u201cToday\u2019s decision is the first small step towards addressing the crisis of insecure work and casualisation in Australia\u2019s workforce.\u201d<\/p>\n<h3><strong>Grounds to refuse casual conversion<\/strong><\/h3>\n<p>Under the decision, there are some conditions in which an employer can refuse permanency for a casual employee. These include:<\/p>\n<ul>\n<li>A significant change to the employees\u2019 current hours to accommodate them as a permanent employee.<\/li>\n<li>It is known or probable the current position will \u00a0no longer exist.<\/li>\n<li>The employees\u2019 hours are foreseeably likely to significantly change or reduce in the next 12 months.<\/li>\n<\/ul>\n<h3><strong>Minimum work hours set across the board<\/strong><\/h3>\n<p>The FWC decision also dealt with arguments on minimum shift length. The ACTU was unsuccessful in claims for a minimum 4-hour shift for casual and part-time employees. The Commission decided this could be counterproductive for some industry awards. However, it reached provisional view that 34 awards without minimum shifts will be now include a 2-hour minimum for casuals.<\/p>\n<p>\u201cWe do consider that it is necessary for modern awards to contain some form of minimum engagement period for casual employees in order to avoid their exploitation\u201d, the Commission said.<\/p>\n<p>Mr Willox, however, said the union claim for 4-hour shifts did not reflect what workers wanted.<\/p>\n<p>\u201cMany casuals cannot or do not want to work for four hours.
